Republicans are to blame for the appointment of a radical leftist judge to the 11th Circuit.
The full Senate was scheduled to vote on Judge Embry Kidd’s nomination to the 11th Circuit Monday night. We’ll get straight to the point — Embry Kidd was approved with a 49-45 vote, but the real kicker is that five Republicans did not show up to vote.
Kidd’s nomination was open to rejection by West Virginia’s outgoing Senator, Joe Manchin. Manchin, a former Democrat, voted against Kidd. The GOP only had to walk through the door to prevent the people of Florida and Alabama from being subjected to decades of Embry’s judicial activism.
Republicans who did not vote:
Sen. Mike Braun
Sen. Steve Daines
Sen. Bill Hagerty
Sen. Marco Rubio
Sen. JD Vance
Rubio’s failure to attend a vote which could have an impact on Florida residents is especially baffling. Judge Kidd, who is just one year older than JDVance, could be on the 11th Circuit or even higher for decades.
Florida’s Governor took note of this.
The leftist judge now has a lifetime appointment, and the citizens of FL, AL, and GA will pay the price.
It’s not as if there weren’t plenty of reasons for Republican Senators to vote against Kidd.
Republicans, despite being in the majority, successfully delayed the vote for Judge Kidd by several months due to concerns that he failed to disclose the fact that two of the rulings he made had been overturned. Both cases involved predatory sexual behavior against children. The Senate Judiciary Committee requires that judicial nominees submit a questionnaire to allow the members to thoroughly vet the candidates. Embry Kidd conveniently did not do this.
If Republicans don’t have the hunger and commitment to kick this lame-duck senatorial session to the curb by stopping Joe Biden’s radical judicial appointments from being confirmed, well, that hardly speaks well of their tenacity to boldly enact meaningful change once they take control of the chamber in January.
The second Trump administration can start at any time, but the GOP must be present to demonstrate that they are in charge. Sen. Manchin indicated that he will not vote for any Biden nominees to the judiciary who do not have the GOP’s approval. It’s difficult to imagine an opportunity more ideal for Republicans to end the leftist judicial activism against which they have been railing for years.
Yes, Sens. Rubio and Vance will be distracted by their upcoming promotions, but Mar-a-Lago is a matter of time. Right now, the fight is taking place on the Senate floor.
