Rep. Andy Biggs (R-Ariz.) introduced legislation Monday to remove D.C. district court judge James Boasberg, under the good conduct clause mandated by the U.S. Constitution, over his court decisions involving an Executive Order issued by President Donald Trump.

Biggs stated, “We cannot sit by as activist judges, who mistakenly believe they are more powerful than the duly elected President of the United States, impose their political agenda on American citizens.”

“I cosponsored resolutions for the impeachment of Judge Boasberg. Democrats will block his removal from office through impeachment because it requires two-thirds of the Senate. According to Article III Section 1, my resolution asserts that rogue judiciaries can be removed by a simple majority, just as we confirm them.”

Boasberg blocked Trump’s administration from using the Alien Enemies Act in March. The president had used the act to justify the deportation of Venezuelan Tren de Aragua members. Boasberg called the Trump White House’s actions “incredibly troubling” and “problematic”. He added that the administration was engaging in “an unprecedented use of an act which has been used in World War I, World War II and the War of 1812 when there was no doubt about who the enemy was.”

Boasberg’s Department of Justice and Trump’s Department of Justice are currently engaged in a legal back-and-forth, with the administration claiming that there is no way to obey the judge’s order once the deportation flight has taken off. The DOJ claimed last week that “no court has the authority to compel President Trump to return them” and that there was no basis for reading the Court’s order in the minute as requiring this unprecedented step.

The Trump administration asked the U.S. Supreme Court to intervene on Friday and allow them to continue deportations under the Alien Enemies Act.

Biggs added, “Judge Boasberg has abused his judicial power for political gain and does not comply with the Good Behavior Clause of the Constitution. He cannot remain in this position. Congress must fulfill its promises to the American public, which includes defending the president’s authority to enforce laws.”
