A federal judge has ordered the release of a five-year-old boy and his father from immigration detention, bringing temporary resolution to a case that has drawn significant attention across the nation and abroad.

U.S. District Judge Fred Biery issued the order Saturday, directing authorities to release Liam Conejo Ramos and his father, Adrián Alexander Conejo Arias, by Tuesday. The two have been held at the South Texas Family Residential Center in Dilley, Texas, since their detention on January 20 outside their Minnesota home.

The circumstances of the arrest have become a point of contention between the family and federal authorities. According to school officials in Columbia Heights, Minnesota, immigration agents confronted the father and son as they returned from the child’s preschool. A school board member who witnessed the incident reported hearing someone inside the home pleading with agents to leave the child.

The boy’s mother, Erika Ramos, provided her account of the events from inside the family’s residence. She stated that her husband urged her not to leave the house, fearing she too would be arrested. Ramos, who is pregnant and has another child, said agents brought Liam to the front door after noticing her at the window. She characterized this action as using her son as leverage to draw her outside.

The Department of Homeland Security has disputed this characterization. In a statement issued Friday, the agency maintained that the father attempted to flee without his son to avoid apprehension, and that an officer remained with the child for his safety while others pursued the arrest.

Judge Biery’s written order included unusually pointed language regarding the detention. “Observing human behavior confirms that for some among us, the perfidious lust for unbridled power and the imposition of cruelty in its quest know no bounds and are bereft of human decency,” the judge wrote. “And the rule of law be damned.”

The case gained widespread attention following the circulation of an image showing the young boy wearing a blue hat and backpack as he was taken into custody. The photograph prompted responses from observers both domestically and internationally.

Legal representatives for the detained father and son expressed appreciation for the court’s expeditious action. They indicated they are coordinating with the family to facilitate a safe reunion, noting that the family can now focus on recovering from what they termed a traumatic experience.

Luis Conejo, the boy’s uncle, conveyed his relief at the news. He expressed joy that his brother and nephew would soon return home and that Liam would be reunited with his mother, though he acknowledged the family members remain physically separated for now.

The superintendent of Columbia Heights Public Schools confirmed that the detention occurred as the child was returning from his preschool program. The involvement of such a young child in an immigration enforcement action has raised questions about protocols and procedures in such cases.

The Department of Homeland Security has not responded to requests for comment following the judge’s order. The family now awaits the Tuesday deadline for release as established by the court.
