Elon Musk and his attorney Alex Spiro posted a letter from Gary Gensler (Chairman of the Securities and Exchange Commission) on X.com. The letter was concerning. In the letter, SEC staff said that they had sent a “settlement request” requiring Musk to agree within 48 hours to accept a financial payment or face charges for numerous counts. Musk captioned the picture, “Oh Gary, how could this be done to me?”

If it says, “accept monetary payments”, I believe that they are demanding he pays them. Otherwise, it makes no sense.

The letter continues:

The SEC staff indicated that the demand was the result of a direct from their superiors and that charges were imminent if Mr. Musk did not comply. The Commission and its staff have harassed Mr. Musk for more than six years following a multi-year probe.

Spiro claimed that the SEC even attempted to subpoena Spiro, but he refused. He added that the SEC reopened its investigation into Musk’s Neuralink.

The case number mentioned in the letter suggests that it is related to the SEC investigation into Musk’s involvement on Twitter (now X).

Spiro said it was an “improperly-motivated campaign” against Musk and the companies and individuals associated with him.

Spiro yelled, “We want to know who is behind these actions.” “Whether you or the White House. We will not be intimidated by these tactics or this misguided plan.”

Many people immediately condemned the SEC for its actions. These included Social Capital CEO Chamath Palihapitiya, All-In Podcast host Donald McFarlane, and New Hampshire State Representative Donald McFarlane.

Gensler served as an advisor for the campaigns of Hillary Clinton, and Barack Obama. He was also Chief Financial Officer for the Clinton campaign during 2016. Gary Gensler will be leaving the SEC on January 20.

We have written about the legal action being taken against Musk by the SEC and others, including his acquisition of Twitter.

These threats are also a bit stupid at this point because Donald Trump will soon be taking over. Elon Musk and Vivek Ramaswamy have already been named to head the Department of Government Efficiency. You’d think you wouldn’t want to use threats. The Biden team is not known for its smart moves.

As we learn more, we’ll let you know.
