The Georgia Supreme Court has declined to hear an appeal from Fulton County District Attorney Fani Willis regarding her removal from the election interference case against President Donald Trump and others.
The Georgia Court of Appeals previously ruled that Willis and her office could not continue prosecuting the case, citing an “appearance of impropriety” stemming from a romantic relationship between Willis and Nathan Wade, a special prosecutor she had hired to lead the case.
Willis had asked the state’s highest court to review the appeals court decision. In a 4-3 ruling, with one judge not participating and another disqualified, the Supreme Court declined to take up the case.

The Prosecuting Attorneys’ Council of Georgia will now be responsible for appointing a new prosecutor to handle the case. This new appointee will have several options: to continue the current course of prosecution, to pursue only select charges, or to dismiss the case entirely.

The case involves Trump and 18 others indicted in August 2023 under Georgia’s anti-racketeering law. They are accused of participating in a scheme to overturn the 2020 presidential election results in Georgia illegally. Four defendants have already entered guilty pleas.
This decision raises important questions about the future of the prosecution. The complexity of the case and the resources required may make it challenging to find a willing prosecutor. Additionally, with Trump now serving as President, his prosecution in this case seems unlikely at present.
Steve Sadow, Trump’s attorney, stated that Willis’s “misconduct was egregious and she deserved nothing less than disqualification.” Conversely, Willis expressed disagreement with the court’s decision but indicated her office would cooperate in transferring the case.
This ruling could significantly impact the timeline and direction of the case. However, it’s important to note that 14 other defendants still face charges, regardless of Trump’s current position.
