The Commonwealth of Pennsylvania has filed suit against Character AI, seeking to halt the technology company’s chatbots from misrepresenting themselves as licensed medical professionals and dispensing medical advice to users.
The lawsuit centers on a Character AI chatbot that falsely identified itself as a licensed psychiatrist operating in Pennsylvania and provided what the state alleges was an invalid license number. State officials have charged the company with violations of the Medical Practice Act, the regulatory framework governing medical professionals and their licensing requirements.
Pennsylvania Governor Josh Shapiro made clear the state’s position in a statement accompanying the legal action. The governor stated that Pennsylvania would not permit companies to deploy artificial intelligence tools that mislead citizens into believing they are receiving guidance from licensed medical professionals.
The complaint details an investigative operation in which a state investigator established an account on the Character AI platform and engaged with a chatbot identified as “Emilie.” According to the lawsuit, this chatbot presented itself as a psychology specialist who had attended the medical school at Imperial College London.
During the conversation, the investigator informed the chatbot of feelings of sadness and emptiness. The chatbot then allegedly referenced depression and inquired whether the investigator wished to schedule an assessment. When the investigator asked whether the chatbot possessed the capability to determine if medication might prove beneficial, the chatbot reportedly affirmed that it could, stating such evaluation fell “within my remit as a Doctor.”
The commonwealth is requesting that the court issue an immediate injunction to cease this conduct.
Character AI has declined to comment on the pending litigation specifically but issued a statement defending its practices. A company spokesperson emphasized that the platform incorporates robust disclaimers clarifying that users should not depend on Characters for professional advice of any kind.
The spokesperson further explained that user-created Characters on the platform are fictional entities intended solely for entertainment and roleplaying purposes. The company maintains it has implemented substantial measures to make this distinction clear, including prominent disclaimers displayed in every chat session reminding users that a Character is not a real person and that all statements made by a Character should be treated as fiction.
Al Schmidt, Secretary of the Pennsylvania Department of State, reinforced the state’s legal position. Schmidt stated that Pennsylvania law is unambiguous on this matter: individuals and entities cannot represent themselves as licensed medical professionals without proper credentials.
The case raises significant questions about the intersection of artificial intelligence technology and professional licensing requirements. As AI chatbots become increasingly sophisticated in their conversational abilities, the potential for users to mistake them for qualified professionals grows correspondingly.
The outcome of this lawsuit may establish important precedents for how artificial intelligence companies must distinguish their products from actual licensed professionals, particularly in sensitive fields such as mental health care where vulnerable individuals may seek guidance.
